Terms & Conditions of Hire
These terms and conditions will apply to all hires entered by Crown Marquee Hire unless otherwise explicitly stated to the hirer, in written form, prior to the commencement of any works. Each quotation issued by Crown Marquee Hire will be valid for up to 28 days from the date of issue. Any offer relating to the provision of equipment and services (both verbally and written) is subject to availability upon confirmation of order by the hirer.
1. Booking Process & Terms of Payment
All bookings with Crown Marquee Hire are subject to availability and confirmation.
To secure a booking, clients must provide a non-refundable deposit, as specified in the quotation.
Unless otherwise agreed at the time of booking, the full amount due will be payable no less than five working days ahead of the event.
Should full settlement not be made on the day of hire then Crown Marquee Hire reserves the right to charge interest at 8% per annum plus the Bank of England base rate recorded during the period of hire.
Crown Marquee Hire will reserve the right to charge for any additional work not described within our quotation which can be incurred during the delivery, period of hire or post collection of equipment.
1.1. Payment Methods
We cannot accept cheques at point of delivery unless agreed in writing by Crown Marquee Hire at point of booking.
Cheque payments cannot be accepted any later than no. 10 working days before the period of hire and must be showing as cleared funds in Crown Marquee Hire account prior to delivery.
Payment can be made via BACS or faster payments. This payment must be showing as cleared before the period of hire. Alternatively, the customer must e-mail evidence in the form of a remittance advice from their bank showing that funds have been sent prior to the commencement of any works.
Payment by credit or debit card can be made over the phone, or via a payment link where requested.
Payment made using a commercial debit or credit card will be subject to an additional 2% processing fee.
2. Cancellation and Refunds
Cancellations must be made in writing to Crown Marquee Hire.
The client may be entitled to a partial refund, depending on the notice period provided and any expenses incurred by Crown Marquee Hire
Cancellation more than 28 days before the commencement of the period of hire - 20% of the total hire charge or the value of deposit paid, whichever is greater.
Cancellation between 14 and 8 days before the commencement of the period of hire - 50% of total hire charge.
Cancellation less than 8 days before the commencement of the period of hire - 75% of the total hire charge.
Invoices will be due for payment on or before the date of commencement of the contracted period of hire. Exact payment terms can be found on your invoice.
3. Delivery and Installation
Crown Marquee Hire will deliver and install the marquee at the agreed-upon location and time.
The client must ensure the site is accessible and suitable for installation, with clear access for vehicles and sufficient space for the marquee.
4. Insurance
Crown Marquee Hire provides public liability insurance cover up to £10 million pounds sterling.
The hirer will be responsible for all equipment hired during the period of hire. In the event that Crown Marquee Hire cannot gain access to any item of the equipment hired, then this equipment will remain the responsibility of the hirer until a suitable collection time has been arranged. In addition, Crown Marquee Hire reserves the right to charge for any additional collections or waiting time incurred as a result of disrupted access to the site.
Security of unattended equipment is the full responsibility of the hirer. The hirer will be responsible for any damage or loss of equipment during the period of hire, including theft, wanton damage or vandalism. We strongly advise that the hirer arranges security for the duration of the hire as loses will not be covered by Crown Marquee Hire insurance.
5. Site Conditions
All quotations are provided in the assumption that the site sits on a firm, level setting with easy access for commercial vehicles unless otherwise stated in writing by Crown Marquee Hire.
Crown Marquee Hire cannot be held responsible for any uneven finish to the floor caused by uneven ground conditions beneath. The hirer should arrange to level surfaces prior to commencement of any works.
Where direct lay flooring is to be provided, the hirer will knowingly accept that the ground is to be suitably flat to accommodate.
The hirer accepts that instances where uneven ground causes the flooring to be unstable, rendering the flooring provided unsuitable and/or unsafe, that they may still be liable to the full agreed charge for the supply and installation, at the discretion of Crown Marquee Hire.
Quotations for lighting are made on the assumption that a suitable, safe and sufficient power supply is available within 10 meters of the marquee.
Crown Marquee Hire reserves the right to erect, dismantle and remove the equipment undisrupted of any other conflicting provision of additional goods and services.
The provision of additional goods and services, which are delivered or installed during the commencement of works, will be deemed the responsibility of the hirer.
Crown Marquee Hire will reserve the right to charge the hirer in accordance with Crown Marquee Hire payment terms for any delay resulting from the interrupted provision of other goods and services.
Grass surfaces must be cut short and all debris including dog foul must be removed prior to the installation of equipment.
6. Underground Services
It is the hirer’s responsibility to provide Crown Marquee Hire with the location of any underground services (gas, water, electricity etc) that could be damaged during the installation.
Crown Marquee Hire cannot be held responsible for damage caused to concealed or buried pipes, cables and other services and features unless their positions have been clearly marked on the site by the hirer.
The hirer will be responsible for any costs associated with the repair to unmarked/unidentified services and associated costs relating to their interruption resulting from not being identified to Crown Marquee Hire.
7. Health and safety
Crown Marquee Hire reserves the right, in its absolute discretion, to require the evacuation of a marquee(s) and/or the cancellation of an event to be held in the marquee(s).
In the case of extreme weather forecast during the hire period Crown Marquee Hire has the right to decline the erection and use of the marquee structure and any other equipment. This is for the safety of all concerned.
If high winds are forecast, Crown Marquee Hire will supply a wind management plan to the hirer. It is the absolute responsibility of the hirer to ensure that this wind management plan is this is adhered to. Crown Marquee Hire monitors wind forecasts daily and, if gust speeds are predicted that exceed those set out in our wind management plan, we will contact the Hirer to advise of any action that MUST be taken.
If the wind management plan is not followed, the hirer will be liable for any damages or claims by third parties or costs as described in the hire agreement.
In the event of late cancellation due to poor weather conditions, the hirer will still be liable for any late cancellation charges in accordance with section 1. Booking Process & Terms of Payment and must be aware of this possibility, particularly during winter months. An additional insurance charge, which will cover the cost of cancellation / site changes etc, is available at the hirer’s request.
Post delivery and installation of equipment, the marquee exits and openings will be agreed.
It is the sole responsibility of the hirer to ensure that this is NOT altered or tampered with in any way which may render the structure unsafe.
No items or objects should be hung, attached or suspended from any element of equipment within the internal or external marquee structure.
The use of tape, pins or wires is strictly prohibited, and a cleaning charge will be levied for any residue as a result of failure to comply with these conditions.
8. Liability
Crown Marquee Hire shall not be liable for any loss, damage, or injury arising from the use of hired equipment, except in cases of negligence or breach of contract.
The client is responsible for obtaining any necessary permits or permissions required for the installation of the marquee at the chosen site.
9. Hirers Responsibilities
It is the responsibility of the hirer to provide Crown Marquee Hire with a plan showing where he/she requires the equipment to be erected. Alternatively, the hirer may wish to appoint a representative on the site during the commencement of works to advise on the desired positioning and entrances of equipment and the finished marquee structure.
Throughout the installation process, Crown Marquee Hire will reserve the right at its absolute discretion to erect the equipment in a manner which does not compromise the health and safety of its staff or any third party throughout the period of hire.
If the hirer requests that the equipment be positioned in a way which breeches Crown Marquee Hire health and safety procedures then Crown Marquee Hire will refuse the provision of equipment and services and offer the safest alternative positioning of equipment. In the case that this is not to the satisfaction of the hirer then Crown Marquee Hire reserves the right to charge for the provision of equipment and services in line with the terms of payment and cancellation policy.
The hirer is responsible for obtaining any site permits that may be necessary.
The hirer is responsible and will indemnify Crown Marquee Hire against any loss or damage whatsoever the cause unless the hirer has paid the damage waiver fee referred to on the quotation/confirmation of order.
In no circumstances will the liability of Crown Marquee Hire exceed the total hire charge.
The hirer will remain responsible and indemnify Crown Marquee Hire against any damage or loss caused by their negligence.
In the event of a claim for loss or damage being accepted by Crown Marquee Hire's insurers, the hirer will be liable for the first £1000.00 of any such loss or damage.
10. Furniture Hire
It is the responsibility of the hirer to ensure that all furniture equipment remains within the completed marquee structure throughout the period of hire. Upon completion of delivery and installation of the marquee structure and equipment Crown Marquee Hire will deliver all marquee furniture inside the marquee.
It is the sole responsibility of the hirer to arrange all furniture in its final position prior to commencement of the event. All furniture will be counted prior to delivery and the hirer must ensure that all counted tables and chairs are available for collection inside the marquee following usage.
A minimum charge of £50 will be levied to the hirer for non-compliance in this instance. If any equipment is lost or damaged Crown Marquee Hire reserves the right to charge the replacement cost of this item which will be calculated at £35 per chair and £150 per table.
11. Force Majeure
Whilst every effort will be made by Crown Marquee Hire to complete any orders, Crown Marquee Hire cannot be held liable for variation or non-completion of orders due to Act of God, Fire, Flood, Storm, Gale, Tempest, War, Pandemic, Terrorism, Strikes, Riots, Lockouts or any other civil disturbances.
12. Amendments
Any amendments or changes to the hire terms and conditions must be agreed upon in writing by both parties.
13. Governing Law
Where his agreement shall be governed by the laws of Scotland, England and Wales, and any disputes shall be subject to the jurisdiction of the courts of Scotland, England and Wales, as applicable.
By hiring equipment from Crown Marquee Hire, clients agree to abide by these terms and conditions. Failure to comply may result in additional charges or termination of the hire agreement.
